Every individual (User) who benefits from all personalized printing products (posters, canvas, cards, etc.) and digital services offered through the Fotomagnet website and application is deemed to have agreed to these contractual terms with Fotomagnet İnternet Hizmetleri.

Acceptance and Approval: The moment you start using our website or application, it is deemed that you have read and approved all terms of service and our privacy policy contained in this agreement in their entirety. If you do not agree with the terms, please do not use the Fotomagnet website and application.

Right to Amend: Fotomagnet İnternet Hizmetleri may update the rules and terms of use on this page at any time without prior notice to the user. Your continued use of our website or application means that you accept the updated terms.

Validity: The user's right to benefit from the services will continue only as long as they comply with the rules specified in this agreement.

Order Process

Placing a personalized print order through Fotomagnet and completing the process is subject to the following steps:

Users can benefit from our services by creating a membership or without creating a membership, in which case a membership will be created automatically after the order.

Users prepare their designs by placing photos selected from their own devices onto the product of their choice.

Once their designs are complete, users can create their orders by entering delivery and payment details.

After the order is completed by selecting pre-paid or one of the other methods, it is reviewed by our team and processed.

Data Storage and Privacy

All data and images belonging to completed orders are permanently deleted from our systems when the user deletes their account or requests data deletion. Data is not stored for a longer period except as required by legal obligations.

User data is not shared with third parties without the explicit consent of the user.

The contact information provided by the user while placing an order will be used, with their consent, by the shipping company for the purpose of creating a shipment.

Delivery Process

Orders are aimed to be delivered to the user within 7-10 business days at the latest. Exceeding this period or any potential delays that may occur in delivery do not entitle the user to cancel the order, claim compensation, or demand any rights/fees.

To prevent damage to the products, all orders are carefully packaged and delivered to the contracted cargo company. Fotomagnet İnternet Hizmetleri cannot be held responsible for any damage caused to the packages by the shipping company or its agents during transit.

Delivery of all orders to the address is safely carried out through the cargo company contracted by Fotomagnet.

Liability

Fotomagnet is not responsible for errors, omissions, data loss, or any damages arising from information and files uploaded or entered by the user during the order.

Print quality depends on the resolution and quality of the images uploaded by the user. In the event of defects originating from itself, Fotomagnet agrees to re-prepare and send the products as part of customer satisfaction.

The user is responsible for the accuracy of the photos, designs, texts, and all other order contents they upload. Upon completion of the order, it is deemed that all contents have been checked, approved, and are ready for printing.

Intellectual Property Rights

Fotomagnet is not responsible for any violations of copyright, trademark, design, or other intellectual property rights that may arise from the content uploaded by the user.

The user declares and undertakes that they possess the necessary usage rights over all images, texts, and other contents subject to the order or have obtained the necessary permissions from the right holder, and that these contents do not infringe on the rights of third parties.

The accuracy and lawfulness of the uploaded content are entirely the responsibility of the user. The user agrees to comply with applicable laws and the intellectual property legislation in force in the countries where the product is sent during the use or distribution of the order and products.

Warranty

The user may report their complaints regarding the product through Fotomagnet's communication channels within 14 days from the date of delivery.

If, as a result of the inspection, it is determined that the complaint arises from a printing or production error, Fotomagnet will, at its sole discretion, reproduce the product or refund the paid product price.

Misuse, user-inflicted damages, wear and tear resulting from normal use, or issues arising from inappropriate storage conditions are not covered under the warranty.

General Provisions

Fotomagnet services cannot be used for content that is unlawful, misleading, obscene, contains insults or hate speech, infringes upon the intellectual property or personal rights of third parties, contains malware or malicious code, or supports illegal activities.

The user is solely responsible for the lawfulness of all content subject to the order and for copyright, usage, and all other rights related to this content.

In order to benefit from the services, all information and contact details provided by the user must be accurate, complete, and up-to-date. Fotomagnet is not responsible for problems arising from the provision of false or incomplete information.

It is recommended that our services be used under the knowledge and supervision of an adult when necessary.

Fotomagnet reserves the right to temporarily or permanently restrict or terminate access to services for users who violate or pose a risk of violating these terms of use.

No warranty is given regarding the accuracy, currency, or suitability for a particular purpose of the information and content on our website and application. Fotomagnet cannot be held liable for any direct or indirect damages arising from the use or inability to use the service, or the unauthorized use of the user's account by third parties.

All risks regarding the use of information and content presented within the scope of the website, application, products, and services belong to the user.

In disputes that may arise from these Terms of Use, the laws of the Republic of Turkey shall apply, and the Izmir Courts and Enforcement Offices shall have jurisdiction.
